TO FILE A COMPLAINT ( See Sexual Harassment Policy 3.1)
Any employee who believes (s)he has been the subject of sexual harassment shall report the alleged act(s) as soon as possible to any one of the following:
- the immediate supervisor;
- any departmental management staff;
- any departmental personnel officer;
- any departmental Equal Employment Opportunity (EEO) Officer
- any member of the Department of Human Resources Employee Relations staff, 110 State Street, Montpelier, VT, 802-828-3454.
NOTE: Any employee may consult with the VSEA to request its assistance. (S)he may also file a complaint of sexual harassment in accordance with the grievance procedures prescribed by the contract. The employer shall ensure that complainants and respondents are advised of their right to VSEA representation under the circumstances required by the contract.
The use of the complaint procedure does not preclude any victim of sexual harassment from pursuing any other legal remedy. To explore other remedies, employees may also contact the following:
Vermont Human Rights Commission
The Commission protects people from unlawful discrimination in housing, state government employment and public accommodations. Individuals wishing to file a complaint with the Human Rights Commission (HRC) may contact us by telephone, in writing, in person, or by e-mail. The HRC staff responds to these complaints and asks a few questions to determine if the HRC is the correct agency to accept the charge.
Vermont Attorney General Civil Rights Division
The Civil Rights Unit is responsible for enforcing state laws which prohibit discrimination in employment. However, as a general matter for state employees, the Human Rights Commission fills that roll. State employees might contact the Civil Rights Unit for information, but complaints would have to be brought elsewhere.
U.S. Equal Employment Opportunity Commission
The Equal Employment Opportunity Commission (EEOC) is a federal entity created to enforce the federal civil rights statute that is broadly referred to as Title VII. That law includes the prohibition on discrimination based upon sex. The EEOC investigates charges of employment discrimination. Charges may be filed in person, by mail, or by telephone. If there is not an EEOC office in the immediate area, call toll free 800-669-4000 or 800-669-6820 (TDD) for more information. To avoid delay, call or write beforehand if you need special assistance, such as an interpreter, to file a charge. There are strict time frames in which charges of employment discrimination must be filed, so charges should be made promptly.
